Introduction

 

We at G6 Hospitality LLC (or G6, collectively, “Motel 6”, “Studio 6”, “we”, “us” or “our”) recognize that privacy is important to our guests and users of our websites, mobile apps and other formats (“Sites”).  We understand that you may have questions about the personal information we collect online and at our properties and how we use it. We have developed this Privacy Policy (“Policy”) to address many of those questions. 

 

Personal Information

We collect, use and store personal information for a variety of purposes related to our business as a hospitality company providing lodging and related services.  “Personal information” includes any information that could be used to identify a person as a particular individual.  Examples of personal information we collect include (but are not limited to) such things as your name, address, email address, credit card number, details of your stay at our properties (such as arrival and departure date), social media account information and credentials related to our frequent guest programs.  We endeavor to collect only personal information that is relevant to our business or is required by applicable law.

 

Collection, Use & Disclosures

We collect, use and store personal information in connection with our business and to help us achieve our goal of providing our guests with a comfortable, safe and pleasant guest experience.  For example, we may use personal information to process reservations, to provide goods and services that guests request or that may be of interest or in connection with our marketing or frequent guest programs.  Because the experience of our guests at our properties and with our Sites is important to us, we may also use personal information to inquire or survey guests about their experience at our properties and what actions we can take to improve our services.  We may use or disclose personal information for other purposes as well, such as to comply with legal or regulatory requirements or to protect the safety and security of our guests, employees and others in a manner consistent with company policy and procedure.  Additional information relating to such potential disclosures is included in the “Compliance with Law & Safety & Security” section below.

In connection with our business and goals above, we may disclose your personal information to other parties.  Circumstances where we make such disclosures may include:

Our Service Provider & Suppliers

Like many lodging companies, we utilize one or more third parties in connection with the operation of our business.  For example, we may provide personal information to parties that help us with various functions, such as processing reservations, registering at our properties or sending email or other communications to you on our behalf, including guest satisfaction surveys.  When we do outsource the processing of your personal information to third parties or provide your personal information to third-party service providers, we direct those third parties to protect your personal information in accordance with the terms and conditions of this Policy, with appropriate security measures.

Consumer Insights

Where we retain personal information about you, we may disclose this personal information to other companies that also retain information about you.  These companies, such as market research firms, may combine the information for purposes of market research and quality assurance, thereby enabling them and us to serve you better.  If your personal information is used for direct marketing purposes, you have the right to decline such use by contacting us using the contact information provided below.

Emails about Special Offers and Promotions and Opt-Out

It is our intention to send email communications that we believe may be useful to you, including to help us serve you better. When you provide us with your email address (e.g., as part of a reservation or the check-in process, or by creating an account with us), you may receive transactional emails or occasionally, informational/promotional emails.  You always have the opportunity to ‘opt-out’ from receiving future emails of an informational/promotional nature.  You may elect to ‘opt-out’ by following the instructions provided in the email or make the change in your account settings.  

Targeted Advertising

We may work with other companies to show you advertisements we think you may find relevant and useful. This may include advertisements displayed on our own Site, or advertisements from us displayed on other companies' websites or apps. The advertisements you see may be based on information collected by us or third parties and/or may be based on your activities on our Site or third-party websites.

Business Transfers

As we continue to develop our business, we may sell hotels and other assets, or cease being the manager or franchisor of a property that is currently part of our portfolio. In those circumstances, we may include the personal information collected about you, or control of that personal information, as a business asset in any such transfer. Also, in the unlikely event that we, or substantially all of our assets, are acquired, personal information collected about you, or control of such information, may be one of the transferred assets.

Compliance with Law & Safety and Security

One of our top priorities is the safety and security of our guests and employees.  Unless otherwise prohibited by law, we may use or release personal information to law enforcement or other government authorities when we believe in good faith that doing so is necessary to protect the safety and security of our guests, employees or others.  If we do provide personal information in these circumstances, we will do so in a manner that is consistent with company policy and procedure.  We may also use or disclose personal information where necessary to comply with legal or regulatory requirements.  For example, we may disclose personal information in response to judicially enforceable subpoenas or warrants.  In addition, we might use or disclose personal information in response to claims or in connection with legal proceedings or investigations of potential crimes.   

Like other lodging companies, we also reserve the right to enter your room for any purpose, including to check on the safety, security and well-being of our guests, employees and others or in response to suspicious activities.  We may also enter your room to check on the condition of the room or for maintenance, repairs and other similar purposes.

 

Personal Information from Children

We do not knowingly collect personal information from individuals under 18 years of age without permission from the respective parent or legal guardian. As a parent or legal guardian, please do not allow your children to provide or submit personal information without your permission.

 

Security of Personal Information

We take commercially reasonable efforts to create and maintain appropriate safeguards to ensure that to the extent we control personal information, it is used only as authorized by us and consistent with this Policy, and that personal information is not improperly altered or destroyed.  Unfortunately, no data transmission or storage is 100% secure. We cannot warrant that all data we collect, store and transmit will be completely secure.

Nevada residents – G6 Hospitality LLC and its brands Motel 6 and Studio 6 do not sell personal information. Nevada law allows residents to make a verified request directing us to not sell any personal information as defined by NRS 603A.320. Even though we do not sell any such information, you may still make such a request by sending an email with your first and last name and a valid email address to the following: nvprivacy@g6hospitality.com.

 

Canadian Privacy Rights

Motel 6 does not buy or sell any personal information from third parties.  All personal information we hold is collected from the consumer at the time a reservation is made, when a transaction occurs or during a stay or visit to one of our properties, or it is developed from that information.

Providing your information to us is voluntary. You consent to providing us your personal information when we collect it from you or when you stay/visit our property, but that consent may be withdrawn. We only market directly to those who opt in to receive emails from us, and you may opt out at any time.

Details on what we collect, how we use it and who we share information with is available in the chart below in the Section titled HOW WE COLLECT AND USE PERSONAL INFORMATION.

Canadian residents may request access to their information, correct or amend personal information in cases where accuracy and completeness is deficient, or request deletion of their personal information. We will respond within 30 days of receiving your request, however, we may extend the response time by up to an additional 30 days if we are not able to reasonably respond within the first timeframe. We may require additional information or responses from the consumer in order to verify the request is from a Canadian resident and to verify that the person making the request is authorized or properly identified. You may challenge Motel 6’s compliance with these privacy principles.

We will investigate all complaints received. However, if you remain unsatisfied with our response, you may complain to the Office of the Privacy Commissioner of Canada

 

Other Sites

We are responsible only for this Policy and the content of our Sites. We are not responsible for the data collection and use practices or the privacy policies of third parties, or the use of cookies on third-party websites or apps that you may access from our Sites.

 

Third-Party Media

Our Sites may contain plug-ins and other features that integrate third-party media platforms into our Sites. You will be able to activate them manually. If you do so, the third parties who operate these platforms may be able to identify you, they may be able to determine when and how you use this Site, and they may link and store this information with your social media profile. Please consult the data protection policies of these social media platforms to understand what they will be doing with your personal data. If you activate these plug-ins and other features, you will be doing so at your own risk.

 

Cookies

Our Sites utilize “cookie” technology. “Cookies” are strings of text that a website stores on a user’s computer. Our Sites use cookies throughout the online reservation process to keep together information entered on multiple pages. For example, cookies enable our Sites to “remember” dates entered at the start of a search for room availability at multiple locations. In addition, cookies are used to:  (a) measure usage of various pages on our Sites to help us make our information more pertinent to your needs and easy for you to access; and (b) provide functionality such as online reservations and other functionality that we believe would be of interest and value to you.

The two types of cookies that we use are referred to as “session” cookies and “persistent” cookies. Session cookies are temporary and are automatically deleted once you leave our Sites. Persistent cookies remain on your computer hard drive until you delete them. We do not use cookies to gather any personal information about you apart from what you voluntarily provide us in your dealings with us. Our cookies do not corrupt or damage your computer, programs or computer files. You may set your browser to block cookies (consult the instructions for your particular browser on how to do this), although doing so will adversely affect your ability to perform certain transactions, use certain functionality and access certain content on our Sites.

 

Mobile and Location-Based Services

To book, view, or change a reservation from a mobile device on our Sites, you may be required to provide some personal information, a confirmation number, or password.

We provide mobile apps that can be downloaded to smart phones. These apps have a variety of functionalities that enhance the customer experience. Our Sites may use your device’s Global Positioning System (GPS) technology to locate a hotel near you and/or to provide you with relevant location-based information. We may also share this information with third parties. We will abide by your device’s settings when accessing any geo-location data. To the extent any geo-location data is combined with personal information, that information will be treated as personal information in accordance with this Policy.

 

Franchisees

Many of our locations are owned and operated by independent franchisees that are neither owned nor controlled by us, our affiliates or our subsidiaries.  We may disclose your personal information to franchisees for the purposes described in this Policy.  In addition, franchisees may independently collect personal information and use such information for purposes such as marketing and other such uses.  We direct all franchisees to comply with the terms of this Policy.

 

Correcting/Updating Personal Information

If your personal information changes (such as your zip code), or if you no longer desire our services, we will endeavor to provide a way to correct, update or remove your personal information provided to us. This can usually be done in your account settings or by emailing us at online@g6hospitality.com. Members are not able to unsubscribe from service announcements, which contain important information about the service. We communicate with you to provide requested services and with regard to issues relating to your account via email or phone.

All contents of the Sites are protected by United States and International Copyright and Trademark law. Any unauthorized use is strictly prohibited and may subject a violator to civil and criminal penalties. All rights reserved.

 

Privacy Protection Policy Changes

In the future, we may need to change this Policy. All changes will be included on the Sites so that you will always know what information we gather, how we might use that information and whether we will disclose it to anyone. Changes in treatment of personal information will affect information collected after the change is posted online.

HOW WE COLLECT AND USE PERSONAL INFORMATION

Below we list the categories of personal information that we collect and disclose, where we determine the means and purposes of data processing. We do not sell your personal information. This section does not apply to personal information we collect about our job applicants, independent contractors, or current or former full-time, part-time and temporary employees and staff, officers, directors or owners.

Below we list the categories of consumer personal information we collect. All information is collected directly from consumers who engage with our business, and not from any third-party.

·  Hotel Services –To take reservations, check-in guests, fulfill room bookings or to provide other goods and services to customers.

·  Payments – To process payment for hotel stays or any other goods or services purchased.

· Communications -- To communicate with our customers, potential customers and guests.

· Marketing – To market to our customers, potential customers and guests including our loyalty program.

· Guest Safety – For safety and security of our guests and properties and prevention of crime including theft, fraud and other crimes.

· Improving Our Services – For business improvement and intelligence including but not limited to online reviews, customer feedback, dispute resolution, quality control and customer service.

· Operations – For legitimate business purposes including but not limited to accounting, audit, training, legal matters, compliance, regulatory requirements, taxes, reporting, and billing.

· Reservations - Businesses that provide G6 with services related to hotel reservations including hotel room occupancy, availability or management.

· Payment - Businesses that provide payment processing services.

· Marketing - Businesses that provide G6 with marketing and advertising services including email communications.

· Technology - Businesses that provide G6 with information technology, storage, backup and other technology services that support our business.

· Operations - Government agencies, law enforcement and professional services associated with tax, audits, compliance, regulatory, safety and security, and legal matters.

California Resident Rights

The California Consumer Privacy Act (“CCPA”), grants California residents certain rights and imposes restrictions on particular business practices as set forth below.

We do not sell Personal Information

We do not and will not sell your personal information. We do not sell personal information about residents who we know are younger than 16 years old.

Notice at Collection

At or before the point of collection, notice must be provided to California residents of the categories of personal information collected and the purposes for which such information is used.

Verifiable Requests to Delete and Requests to Know

Subject to certain exceptions, California residents have the right to make the following requests, at no charge:

Request to Delete

California residents have the right to request deletion of their personal information that we have collected about them and to have such personal information deleted, except where an exemption applies.  Exemptions include but are not limited to keeping information in order to comply with legal obligations, enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business, or use the information internally, in a lawful manner, that is compatible with the context in which the consumer provided the information.

Request to Know

California residents have the right to request and, subject to certain exemptions, receive a copy of the specific pieces of personal information that we have collected about them in the prior 12 months and to have this delivered, free of charge, either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, readily useable format that allows the individual to transmit this information to another entity without hindrance.  California residents also have the right to request that we provide them certain information about how we have handled their personal information in the prior 12 months, including the:

•  categories of personal information collected;

•  categories of sources of personal information;

•  business and/or commercial purposes for collecting and selling their personal information;

•  categories of third parties/with whom we have disclosed or shared their personal information;

•  categories of personal information that we have disclosed or shared with a third party for a business purpose;

•  categories of personal information collected; and

•  categories of third parties to whom the residents’ personal information has been sold and the specific categories of personal information sold to each category of third party.

California residents may make Requests to Know up to twice every 12 months.

Submitting Requests

Requests to Know, and Requests to Delete may be submitted on our California Consumer Privacy Act page. To submit online, Click Here.  You may also contact us at 1-855-202-5784 (toll free). We may require additional information or responses from the consumer in order to verify the request is from a California resident and to verify that the person making the request is authorized or properly identified. Once your request has been verified, we will respond as required by law. We will make the disclosure within 45 days of receiving your request, unless we request an extension. In the event that we reasonably need a 45-day extension, we will notify you of the extension within the initial 45-day period.

 

Right to Non-Discrimination

The CCPA prohibits discrimination against California residents for exercising their rights under the CCPA. Discrimination may exist where a business denies or provides a different level or quality of goods or services, or charges (or suggests that it will charge) different prices, rates, or penalties on residents who exercise their CCPA rights, unless doing so is reasonably related to the value provided to the business by the residents’ data.

Financial Incentives

A business may offer financial incentives for the collection, sale or deletion of California residents’ personal information, provided the incentive is not unjust, unreasonable, coercive or usurious, and is made available in compliance with applicable transparency, informed consent, and opt-out requirements. California residents have the right to be notified of any financial incentives offers and their material terms, the right to opt out of such incentives at any time, and may not be included in such incentives without their prior informed opt-in consent.

We offer financial incentives as part of our My6 Program. Participation in My6 is opt in only. You may opt in by opening a My6 account and creating a password on the My6 Program webpage. Financial incentives include email offers for room discounts, typically for 10% off of the room rate. You may withdraw from the financial incentive at any time by logging into your My6 account and changing your subscription status.

We do not discriminate or treat a consumer differently because the consumer exercises a right conferred by the CCPA. California residents may make requests pursuant to the CCPA as detailed above and still receive emailed discounts by requesting that we keep an email address on file in the My6 Program to receive the offers.

Retention Period

We will retain your personal information for as long as necessary to fulfill the purposes for which we collect it and as set out in this Policy and for the purpose of satisfying any legal, accounting, or reporting requirements that apply to us.

Your Choices and Rights – Rest of the World

Depending on the jurisdiction in which you are located, you may have certain rights with respect to your personal information. For example, you may have the following rights:

  • Right to know and decide relating to your personal information;
  • Right to limit or refuse the handling of personal information by other parties;
  • Right to consult or receive a copy of your personal information;
  • Right to request a transfer of your personal information;
  • Right to delete your personal information;
  • Right to complete or correct inaccurate, out-of-date, or irrelevant personal information;
  • Right to request information regarding personal information handling rules; and
  • Right to have your next of kin exercise these rights.
